Abstract

This article critically examines the religious rights of individuals identifying as LGBTQ (Lesbian, Gay, Bisexual, Transgender, and Queer) from the perspective of Islamic jurisprudence while considering contemporary societal challenges. Particular attention is given to their entitlement to religious education, counselling, and spiritual guidance consistent with Sharīʿah principles, as well as access to rehabilitation initiatives intended to support moral development, social well-being, and meaningful participation in society. By employing fiqh approaches such as fiqh al-wāqiʿ and primary sources including the Qur’an, Hadith, and legal documents, in addition to literature related to guidance (irshād) and rehabilitation (iṣlāḥ), this study elucidates the importance of protecting these fundamental religious rights. Furthermore, it details the multifaceted challenges spanning theological, legal, and sociological dimensions encountered during the practical implementation of programs designed to actualize these rights. The study further highlights the importance of integrating spiritual guidance, psychosocial support, and community engagement in addressing the needs of LGBTQ individuals within an Islamic framework. Particular attention is given to rehabilitation initiatives such as Mukhayyam, which provide structured opportunities for religious learning, self-reflection, and personal development. These initiatives demonstrate that the protection of religious rights extends beyond legal and theological considerations to include access to supportive environments that nurture spiritual growth, strengthen personal resilience, and facilitate meaningful participation in religious life. In conclusion, this paper underscores that the continuity and strategic refinement of rehabilitation and guidance platforms are essential for ensuring that LGBTQ individuals receive comprehensive spiritual and psychological support, affirming their right to an appropriate path within the religious community.
