The Standing of Human Rights in Criminology and Victimology: An Analysis of Contemporary Islamic Law

This research aims to analyze the position of human rights in the realm of criminology and victimology using a contemporary Islamic law approach. Criminology highlights aspects of crime in society, while victimology focuses on the study of crime victims. Both are closely related to the protection of human rights. This study employs a normative juridical research method with a qualitative approach through comparative legal analysis. The research relies on library research by examining primary, secondary, and tertiary legal materials, including Islamic legal sources, legislation, scholarly journals, books, and relevant literature related to human rights, criminology, and victimology. The focus of the study includes the basic concepts of human rights in Islam, protection of crime victims, handling of criminals, and the social responsibility of society. The results of the analysis highlight that Islamic law provides a strong foundation for understanding human rights in the context of criminology and victimology. Principles such as justice, equality, and protection of individual rights are strongly recognized in Islamic teachings. Furthermore, the social responsibility of society in preventing crime and supporting victims is also emphasized in the perspective of Islamic law.
